The Service members’ Civil Relief Act (SCRA) was enacted to give active service members protection in certain civil actions that could adversely affect them during their military service. The act was designed to help active service members focus on their military duties without the distraction of civil legal actions.
The act protects all members of the US military who are on active duty as well as US citizens serving in the military of US allies, and in some cases reservists and inductees who have not yet reported to active duty.
Members of the armed services will be glad to hear that the SCRA applies in bankruptcy cases. The act provides service members with protection against default judgments and gives the court the power to stay proceedings against debtors who are in the military.
Bankruptcy court clerk’s offices in Arizona and throughout the US should be aware that a plaintiff must provide an affidavit stating whether or not the debtor is in the military before any default judgment can be made.
