Providing Arizona Debt Relief Through Bankruptcy Discharge

Our goal at the Pew Law Center is to provide unsurpassed Arizona debt relief representation to every one of our bankruptcy clients. For most individual consumers who seek our help, that will mean a bankruptcy discharge from debt. The court’s discharge order provides Arizona debt relief by permanently stopping any further collection efforts by creditors on the discharged obligations. A bankruptcy discharge order depends upon the Arizona debt relief sought under a Chapter 7 Liquidation, a Chapter 11 Reorganization, or Chapter 13 Individual Debt Adjustment.

Chapter 7 Liquidation

Filing for Arizona debt relief under Chapter 7 of the U.S. Bankruptcy Code will involve the selling, or liquidating, of any nonexempt assets the debtor owns with the proceeds distributed to creditors, if there is anything to distribute. All or most property will be exempt and unavailable to creditors in bankruptcy!

Your Chapter 7 Arizona bankruptcy discharge means you will not have to repay any of the debts that remained after liquidation. (Arizona debt relief does not include the discharge of domestic support obligations (DSOs) like alimony and child support – those are non-dischargeable debts in bankruptcy.)

Chapter 13 Individual Debt Adjustment

When you file for Arizona debt relief under Chapter 13, a court-confirmed monthly repayment plan is in place for three to five years, with the discharge following the completion of your plan.

Chapter 11 Reorganization

Under the protection of the Chapter 11 bankruptcy court, the debtor in possession (DIP) stays in control of the business assets during the debt restructuring process. A court-confirmed plan is put in place and continues until the bankruptcy case is dismissed or is converted to a Chapter 7.  When the court-confirmed plan is completed, the petitioner is discharged from the debts that arose before the plan’s confirmation, providing the business debtor with significant Arizona debt relief.
