Warning: Be Sure to Visit an Approved Arizona Credit Counselor before Filing Chapter 7 Bankruptcy

If you are filing for Chapter 7 Bankruptcy in Arizona, or any other state in the US, you must be sure that all of your paperwork is in order before you file. For example, you need to complete credit counseling with a US trustee approved agency and receive a credit counseling certificate to file with your bankruptcy petition.

If you file your bankruptcy petition before you have this certificate in hand, if the certificate is older than 180 days, or you forget to file the certificate, your bankruptcy may be summarily dismissed. That means that you will lose your filing fee and your debts will not be discharged. And if you attempt to file again within one year after the dismissal, protection from your creditors may be limited to thirty days.

In some cases, you may be eligible for extension to complete counseling after filing. If you attempted to get counseling before filing bankruptcy but were not able to get counseling within the five day window of the request, and there are emergency circumstances that require you to file your bankruptcy immediately, and you file a citation stating the above facts along with your petition you may be granted an extension.  However, the judge will decide what makes for an “emergency” in regard to filing, and if the judge does not agree with you, your case will be dismissed anyway.

In some cases, active combat military personnel or those with physical or mental impairments that would make them unable to complete credit counseling may be granted a waiver by the court.
